Terms of Service

The German version of this document is the operative one. This English translation is provided for convenience; where the two differ, the German text governs.

1. Scope and provider

These terms govern the use of the hosted netrics service at app.netrics.so, including its apps for TVs (the "service"). The provider is Lab80 – Florian Preusner, Freester Weg 10c, 13503 Berlin, Germany, trading as a sole proprietorship.

The netrics software is open source under the GNU Affero General Public License v3 (github.com/netrics-so/netrics). If you run it yourself, that licence applies and these terms do not.

2. Account and workspaces

The contract of use comes into effect when you create an account. You must be at least 16 years old. Keep your credentials to yourself; you are responsible for activity under your account. If you create a workspace and invite others, you decide who has access to it and to the data in it.

3. Free trial and paid plans

The hosted service is a paid subscription. Every new account starts with a free trial of 30 days. The trial ends on its own: you are not charged anything unless you choose a paid plan. To keep using the service after the trial, you need a paid plan. Prices, the billing period and how to cancel are shown to you before you buy, and a paid plan applies only once you have chosen it.

Running the netrics software yourself is free of charge under its open-source licence (section 1).

Early access. Paid plans are not available yet. Until they are, the hosted service is in early access: we charge no fees, and your use is not limited to the trial period. We will tell you by email before paid plans start; fees apply to you only once you choose a paid plan.

4. Data sources

You may connect only accounts and properties you are entitled to use. netrics reads data from them on your instruction and with read-only access where the provider offers it. The terms of those providers (for example Vercel or Google) continue to apply to your accounts there. You can disconnect a data source at any time.

5. Acceptable use

Do not use the service to infringe the rights of others, to process data you are not allowed to process, or to disrupt or probe the infrastructure. We may apply reasonable limits to protect the service, such as on the number of connections, sync frequency or API requests.

6. Your data

Your dashboards and the data from your sources remain yours. We process them only to provide the service to you, as described in the privacy policy.

7. Availability and liability

We work to keep the service available and your data safe, but cannot promise uninterrupted operation, and figures depend on what your data sources deliver. We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. For slight negligence we are liable only for breaches of essential contractual duties, and then capped at the typically foreseeable damage. Liability under the German Product Liability Act is unaffected.

8. Term, termination and changes

You can end the contract at any time by asking us to delete your account (privacy@netrics.so). We may end it with four weeks' notice, or without notice for good cause, for example a serious breach of these terms. If we change these terms, we will tell you by email in advance; changes that affect you adversely apply only with your consent.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory provisions of their country of habitual residence remain unaffected. Place of jurisdiction is determined by statute. We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board.
